A puzzle for the legal boffins not for us mere mortals...

In a worldwide first for a small unincorporated UK registered charity in the heart of Stanground, we salute Alan Brian Coulson the ex-officio chairman of registered charity 271705 who has managed pull off the impossible! 

Alan (call me Brian)  has engineered the appointment of a series of new Charity Trustees, in methods new and unknown to Charity Law,  despite the fact that the formal first committee meeting for newly appointed charity trustees broke down just a short time ago and not a single trustee completed the formalities as they were shocked to learn they might be liable for past substantial financial losses.

Cllr. Irene Walsh and former Mayor of Peterbough, present at the meeting before it broke down, suggested that any outstanding financial questions to Alan Brian Coulson should be quickly addressed and in writing in answer to your scribes reasonable requests for detailed information on the financial health of the registered charity as no accounts had been prepared for over 1,500 days according to the Charity Commission. The situation is still the same although 2010 accounts were lodged but then over a 100 days late....  The questions still remain unanswered... deep holes in charity accounts is a very serious matter for trustees to consider.

The new 'appointments' suddenly appeared  without notice on the Charity Commission website in the last few days using a passcode requested by your scribe, but used by persons not authorised to do so, as a result the PFNW telephone has been ultra busy.

We'd hate to say the well intentioned new trustees were duped, but records will show there has been no formal election of the new trustees which has to go through a very controlled legal process and they probably don't realise that without trustee indemnity insurance in place they are all jointly and severally liable for any and all financial losses incurred by the registered charity.

The will also realise that as Trustees they are never paid, except in exceptional well docmented circumstances and can only recover at best out of pocket expenses.

At the recent first committee meeting, where your scribe performing the role of Secretary, (and about to take up the mantle of Charity Trustee having noted that no accounts had been filed for many years) was not unduly alarmed that the newly elected  trustees all refused to confirm their appointments when told that they would be jointly and severally liable for the unknown possibly substantial financial losses incurred by the unincorporated charity in the care of the Coulson family of connected trustees over the last five years.

The charity under Alan Brian Coulsons charimanship has failed to prepare any accounts since 2005  bar the recent accounts for 2010 which show that losses year on year have eaten into the charity reserves. Just where has the money gone? We should be told....

One member (not your scribe) estimates that each new trustee could be immediately taking on a personal debt of around £12,000. Your scribe however estmates that might be on the low side and the new trustees should budget for a substantially higher amount especially as no trusteee indemnity insurance will be in place to protect them from personal financial loss.... we should also congratulate JACQUELINE CLARK who as a charity trustee will now longer be taking any tax free 'wages' from the dwindling charity bank account for the regular keep fit classes.... her selfless public spirited action is to be applauded...

We will return to this topic later and any new information is always welcome.
