Do YOU really want to be on a local Committee?



There are over 250 charities in the Peterborough area (including Stanground Community Association as we show below) that have as of today failed according to the Charity Commission [CC] to complete an annual return, supply a copy of the yearly accounts and also a written Report on activities undertaken during the year in question. Committee members when they sign the minutes book for the first time, also sign up to be Trustees under the Charities Act 2006 and undertake a series of legal obligations as set out by the Charities Act 2006.

Knowledge of obligations as a Charity Trustee is important as the legal penalties and personal sanctions have been increased and responsibilities to strictly meet charitable objectives have been tightened up and changed.

A booklet has now been published "Charities Act 2006 What trustees need to know..." a copy or copies are available free from 0845 015 0010, simply quote the reference number URN 07/Z2 and the number of copies required.

If you are on any local committee or just an interested resident have a look at the booklet and question your committee. You may just save them a trip to the High Court!  If the trustees fail to submit the documents within months of the financial year end and/or ignore the limitations/charitable objectives as set out in their constitution (governing document) then the CC can step in, obtain a High Court order,  seize documents, protect the assets of the Charity and in some cases appoint a professional interim manager to take over the day to day running of the charity. In these cases any legal liability insurance is null and void and the trustee is at personal financial risk for any losses the charity might have made in addition to paying for legal costs and any fines imposed by the Courts. The Charity Commission will also accept online complaints, if you feel your committee members or the charitable objects of the registered charity are being flouted. You need not be a member to make a complaint.
